Terms and Conditions

Shipment means all goods, documents, parcels that go under one waybill issued by HanaBee Logistics. Every Shipment is transported on a limited liability basis. If Shipper requires, value insurance may applied at an additional cost.

1. Custom clearance

HanaBee Logistics is on Shipper´s or Receiver´s behalf in order to perform customs clearance.

2. Unacceptable Shipments

A Shipment is deemed unacceptable if:
a. No customs declaration is made when required by applicable customs regulation.
b. It contains counterfeit goods, illegal goods, live animals, currency, gem stones, precious metals, weapons, explosives and ammunition, narcotics,...
c. It is classified as hazadous material, dangerous goods, probihited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization) or other relevant organizations.
d. It contains any items which HanaBee Logistics considered as unsafe or illegal ones
e. It is in defective or inadequate packaging condition.
f. Its address is incorrect.

3. Undeliverable

If Shipment is refused or rejected by Receiver and/or customs authority, HanaBees Logistics shall have the right to return Shipment to Shipper at Shipper´s cost.

4. Inspection

HanaBee Logistics hold the right to open and inspect a Shipment without notice.

5. Shipment charges

Shipment charges are calculated according to actual or volumeric weigh which is weighed and measured by HanaBee Logistics.

6. HanaBee Logistics´ liability

HanaBee Logistics liability is trictly limited to direct loss and damage to the Shipment only, excluding lost profits, income, interest, future business related to the Shipment even with prior notice.

7. Claims

All claims must be submitted in writing to HanaBee Logistics within thirty (30) days from the date that HanaBee Logistics accepted the Shipment, failing which HanaBee Logistics shall have no liability whatsoever.

8. Shipment insurance

HanaBee Logistics may be able to arrange insurance covering the value in respect of loss of or damage to the Shipment provided that the Shipper so instruct HanaBee Logistics in writing.

9. Circumstance beyond HanaBee Logistics´ control

HanaBee Logistics is not liable for any loss or damage arising out of circumstance beyon HanaBee Logistics´ control such as: any defect or characteristic related to the nature of the Shipment; any act or omission by Shipper, Receiver, third party, customs or other goverment official; Force Majeure: earthquake, storm, flood, plane acccident, war, embargo, riot, strike.

10. Shipper´s warranties and indemnities

Shipper shall indemnify and hold HanaBee Logistics harmless for any loss or damage arising out of Shipper´s failure to comly with the following warranties:
a. All information provided by Shipper is complete and acccurate.
b. The Shipment is acceptable for transport under section 2 above.
c. Shipper has complied with all applicable customs, import, export, data protection, laws, sanctions, embargos and other laws and regulations.
d. Shipper has obtained all necessary consents in relation to personal data provided to HanaBee Logistics including receiver´s data as may be required for transport, customs clearance and delivery, such as email address and mobile number.

11. Routing

Shipper agrees to all routing and diversion, including the posiblity that the Shipment may be carried via intermidiate stoping places.

12. Governing law

Any disputes arising under or in any way connected with these Terms and Conditions shall be subject to the Japanese Law.
